1. Acceptance of Terms of Service The System that you are currently accessing, which may include related games, simulations, calculations and interactions, apart from other content and knowledge, (herein referred as "System") is developed and published by Aktrea Capital Pte Ltd ("Aktrea"). All Intellectual Property ("IP") Rights are exclusively owned by Aktrea and its licensors, other than where such IP is from publicly available sources. You, the user of the System (herein referred as "You/you"), are advised to read these Terms of Service ("Terms of Service") carefully and agree to them prior to accessing and using the System. Your use of the System, website and /or any other information and exchange media made available by Aktrea and any Systems that you use in connection to this are governed by these Terms of Service ("Terms of Service"). BY ACCESSING OR USING THE SYSTEM, YOU ACCEPT AND UNDERTAKE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT ACCEPT THESE TERMS OF SERVICE, PLEASE DO NOT ACCESS AND/ OR USE THE SYSTEM. Subject to your acceptance, and compliance with these Terms of Service, Aktrea grants you a personal, limited, non-exclusive, revocable and non-transferable license to use the System for your personal and commercial purposes as set forth in these Terms of Service. Please note that the terms and conditions related to privacy and protection of your personal information are governed by the Privacy Policy provided in the Login Page ("Privacy Policy"). You hereby confirm that you have read and accepted our Privacy Policy.

3. Provision and use of the system Aktrea has the right to provide the System as it deems appropriate, including the right to amend the System. If access to the System requires changes in your operating environment, you shall make such changes at your own expense. Aktrea aims, on a best efforts basis, to notify you of any substantial changes that could materially affect the use of the System with a reasonable notice period. Aktrea may suspend the System where necessary- for example, for installation, amendment or maintenance work; if laws, regulations or authorities so require; or if there are other justifiable reasons for suspension. Aktrea aims to ensure that the suspension is as short as possible. Aktrea has the right to terminate the System at its sole discretion. If any suspensions or termination of the System occur, Aktrea aims to reasonably notify you of such occurrences beforehand. You agree to use the System in a manner that does not cause harm to Aktrea, other users or third parties. Aktrea reserves the right to terminate or restrict your access to the System without prior notice if you violate these Terms of Service or if you abuse the System or load the System to an unusual extent. Aktrea is entitled to prevent access to the System if it has reason to believe that you are engaged in illegal activities or compromise other users' or Aktrea's data security or privacy. Aktrea may use subcontractors to fulfill its obligations pertaining to the System and/or these Terms of Service.

4. Products, Payment and refund By making payment of the amount agreed between You and Aktrea, and then accessing the System, you obtain access to certain products (herein referred as “Products”) of Aktrea which may include business training programs in the form of computer games and simulations for but not limited to educational, recreational, interactional, evaluation or contributory purposes. Any payment made to Aktrea for above mentioned products will not be refunded in any case.

5. Content Aktrea has created the System and related products with an objective of one or more of the following purposes:

• Education
• Interaction
• Engagement
• Recreation
• Networking
• Learning
• Discussion
• Evaluation
• Contribution

The content and the material in the System and Products (collectively referred to as “System Content”) herein can be derived from any of the following sources: Aktrea sources (referred to as “Aktrea proprietary content”), public sources (referred to as "Public content"), licensed from an owner of the System ("externally licensed content") or your Company or Employer (referred to as "Customer proprietary content"). Aktrea takes reasonable efforts to provide you with System and Product information that are as accurate as possible. Aktrea does not, however, warrant that the System or Product information or other content on the System is accurate, reliable, complete or error-free. If a Product offered by Aktrea itself appears to be contrary to the Product information provided by Aktrea, your sole remedy is to discontinue usage of the System and notify Aktrea about the same. No Payment made will be refunded in any case. Any System content cannot be reproduced by you in any manner.

6. Intellectual Property Rights Aktrea (or its licensors) shall own all rights, title and interest in and to the System as well as any material in or provided through the System, including any copyright, patent, trademark, design right, trade secret and any other intellectual property rights (collectively referred herein as "Intellectual Property Rights") other than the Customer Proprietary content, Public content or Externally Licensed content. Where Customer proprietary content has been used, a separate agreement has been put in place between Aktrea and the owner of such content which allows the use of such content in the System or Products. You acquire no ownership rights by using the System. Also, you undertake not to reverse engineer any content or System characteristics and create any System similar to, or based on System and products accessed by you.

7. Feedback In connection with your use of the System, you may provide Aktrea with suggestions, ideas, reviews, comments, questions or other information and/or material regarding the System ("Feedback"). After providing the Feedback to Aktrea, you continue to retain any Intellectual Property Rights to the feedback so provided. You may grant Aktrea and its partners a worldwide, perpetual, irrevocable and royalty-free right and license to use, copy, amend, modify, translate, further develop and make derivative works of the feedback. You also acknowledge that you give to Aktrea, without charge, the right to commercialize your feedback in any way and for any purpose. Aktrea has no liability for any loss or damage suffered by you as a result of the disclosure or use of such feedback. You agree not to provide Aktrea with Feedback that is subject to a third-party license that requires Aktrea to license the System or the material contained therein to third parties because Aktrea includes your feedback in the System. Further, Aktrea does not solicit or wish to receive any feedback from you that is deemed confidential or proprietary, unless specifically so requested by Aktrea. Any feedback submitted by you to Aktrea will be deemed non-confidential or non-proprietary, unless Aktrea has specifically stated otherwise. Notwithstanding anything to the contrary, the protection of your personal data is at all times subject to Aktrea's Privacy Policy.

8.Indemnification Under this Terms of Service, you shall be liable and agree to indemnify Aktrea and third parties for and against all damages, which are caused by your unlawful behavior or breach of these Terms of Service. For instance – you cannot use Systems to promulgate any issue which is discriminatory, defamatory, abusive or derogatory to any nation, community, government, individual, religion, enterprise, company, incorporation, and the like. Promulgating any such issue through usage of Aktrea's Systems is solely at your own discretion, and Aktrea shall not be liable for any damages arising out of it. In such cases, you will be held personally liable for all damages.

9. Links to Third party sites The System may contain links to sites, which are owned or operated by third parties ("Third Party Sites"). Aktrea shall not be responsible for any content or products or services offered by third parties. Further, the content on Third Party Sites may be subjected to separate terms of service and/or privacy policies, the contents of which Aktrea recommends you review.

10. Force Majeure A force majeure event shall discharge Aktrea from its obligations with respect to the System when the said event prevents or unreasonably impedes the performance pertaining to the System. Examples of force majeure include but are limited to fire, earthquake, flood, explosion, strike or other stoppage of work, orders of public authorities, disruption of energy supplies, shortage of raw materials or equipment, disruption of cable or other data communications caused by or arising from outside factors, or other comparable causes that were not foreseen and that could not reasonably have been prepared for in advance. Aktrea shall seek to announce force majeure through the System immediately whenever such announcement is possible.

11. Amendments and Termination Aktrea has the right to amend these Terms of Service at its own discretion. Aktrea delivers the amended Terms of Service to you or your Employer/Company via the System or some other suitable means at its discretion. While an attempt will be made to separately notify you of any change to the Terms of Service, you are requested to check for any changes to the Terms of Service when you use the System. Your continued use of the System after such amendments have been made shall be deemed as your acceptance of the amended Terms of Service. In case you object the entry into force of the amended Terms of Service and if you and Aktrea do not agree otherwise in writing, your right to use the System shall terminate on the date the amended Terms of Service enter into force. Aktrea may also at its discretion notify you of amendments and make the amended Terms of Service available without prior notice upon the next time you access the System and make it conditional for continued use of the System by you to specifically accept the amended Terms of Service (for example by clicking "Accept"). However, if you choose not to accept the amended Terms of Service made available to you in accordance with this paragraph, your right to use the System shall terminate immediately. If, at any time, any provision hereof becomes illegal, invalid or unenforceable in any respect under the law of any jurisdiction, the legality, validity or enforceability of the remaining provisions shall in no way be affected or impaired thereby. The invalid provision shall be replaced by a valid one which achieves the original purpose and commercial goal of the valid provision to the extent possible.

12. Limitation of Liability The System is provided on an "AS IS" basis without warranties of any kind. Aktrea does not warrant that the System will function without interruptions or will be error-free. Aktrea shall not be liable for the correctness, exhaustiveness or reliability of the information or other material presented in the System nor for the content or other features of the products or services offered on or conveyed through the System. Further, Aktrea shall not be liable for the System content, including without limitation the data, or any other information exchange media on or connected with the System. Aktrea shall not be liable for direct or indirect damages caused by a possible delay, a change or loss of a service, product or material transferred through the System. Aktrea shall not be liable for direct or indirect damages caused by interruptions and disturbances including loss or delay of data or changes in data due to technical defects or maintenance. Further, Aktrea disclaims any liability for direct or indirect damages caused to you by harmful programs (viruses, worms or the like) or incorrect content in the System. Aktrea bears no liability for damages caused by you or by a third party. Aktrea's maximum liability for direct damages caused to you or your property is always limited to the amount paid for the Product(s) ordered by you via the System that gives reasons for the claim. Aktrea is never liable for any indirect or unforeseeable damages caused to you under any circumstances.

13. Content and possibility of taking offence to any System content Aktrea makes no representation to the accuracy or completeness of any information herein or otherwise provided by us. This information is subject to change without notice. This System and System content, including but not restricted to various situations and behaviors depicted, or choices made by you while accessing the System, or content displayed, is for educational purposes only and to an extent, intended to illustrate different situations and behaviors. The main purpose of the System is to provide education and learning. Sometimes, situations, case studies, role-plays and material could depict scenarios in real-life for illustration and learning. These scenarios could be construed by some individuals as being discriminatory, insulting, demeaning or distressing. It is not Aktrea's intention to cause such reactions, and Aktrea bears no responsibility for views expressed, sentiments and opinions that might affect you or other users of the System during, and after access to the System.

The System has been created in good faith and you will be wholly responsible for any repercussions of incidents during and related to the use of the System by you, your associates and your colleagues System content is not intended to offend any person and not intended to be discriminatory or selective to or against any person, race, nationality, gender, orientation, ethnicity or any other categorization that may or may not exist. By accessing the System, you agree to indemnify Aktrea against any possible legal, civil or any other action on account of discrimination or intent to malign. Any offence caused, or any sentiments hurt is purely coincidental and any resemblance of any of the characters depicted in the System to any person living or dead is deeply regretted.

14. Content not to be construed as advice for real-life situation No reliance should be placed on the techniques mentioned herein, and expert advice should be sought prior to any real-world decision, behaviour or interaction. Nothing in this System, including presentation, material, course or discussion is intended to be investment, behavioural or any other form of advice.

15. Applicable laws and settlement of disputes These Terms of Service and the contractual relation related thereto shall be governed by the laws of the Republic of Singapore. Any dispute arising out of these Terms of Service or the contractual relation related thereto will be attempted to be settled amicably. If no agreement is attained, the dispute shall be settled in the Courts of Singapore.

Privacy Policy

1. Background and our commitment to your privacy Aktrea Capital Pte Limited and its subsidiaries and affiliates ("Aktrea") are committed to respecting your privacy. This Privacy Policy and Statement of Cookies (referred herein as the "Privacy Policy") discloses our privacy practices and expresses our commitment to keep you, the user ("You") informed of the information that we collect and how this information can be used with respect to the System that you are currently accessing, which could include related games, simulations, calculations and interactions, apart from other content and knowledge (referred herein as "System"). The System is developed and published by Aktrea. All Intellectual Property ("IP") Rights are exclusively owned by Aktrea and its licensors, other than where such IP is from publicly available sources. Your use of the System, website or any other information exchange media, made available by Aktrea are governed by the Terms of Service ("Terms of Service") given in the login page.

2. Scope This Privacy Policy applies to and governs data collection and usage of the System by you. The System, including the content, features, and any microsites, blogs and discussion groups may be hosted by Aktrea or by third party service providers that collect personally identifiable information and perform other tasks on behalf of Aktrea ("Branded Sites"). These Branded Sites are also governed by this Privacy Policy. The System may also be in the form of a mobile or device Application ("App") which may be available and hosted on servers of other service providers which may include platforms and App services such as but not limited to those offered by Apple Inc., Google Inc., Microsoft Inc., Amazon Inc. and Facebook Inc. While data procured by Aktrea through the usage of these Apps will be governed by the Policy, Aktrea cannot vouch for the privacy of data secured through such platforms as provided by service providers, since the service providers themselves each have a separate Privacy Policy that you should review prior to using the Apps on such platforms.

3. The information we collect and how it is used You make the decision whether or not to proceed with any activity that requests personally identifiable information, but please be aware that if you choose not to provide the information so requested, you may not be able to complete certain transactions with Aktrea. Sometimes, such as when you register for a service, order a product or make other requests or inquiries, we will ask for specific information about you in order to provide that product or service to you or respond to your requests or inquiries. We may collect certain personally identifiable information such as contact information, including your name, e-mail address, work and home telephone numbers, fax number and a physical postal address. We may also collect information regarding your personal or professional interests, demographics, past experience with Aktrea products and services, detailed contact preferences or other personally identifiable information. We may use any information that we collect, including personally identifiable information, to tailor subsequent communications to you, including marketing and promotional communications, to administer and operate the System and our business and to provide and continually improve Aktrea's offerings. We may also share information that we collect, including personally identifiable information, with resellers or other third parties in order to market Aktrea products and/or services to you. We do, however, provide our users a choice as to whether or not they would like to receive marketing or promotional communications. Please see Section 5, Choice. Users may from time to time receive up-to-date information on products and services via our e- mail newsletter. Users may opt-out at any time from receiving these communications. Please see Section 5, Choice. We may also periodically conduct business and individual user surveys because they provide us with important information that helps us to improve our products and services. Participation in such surveys is completely voluntary and you, therefore, have a choice whether or not to disclose this information. Any personally identifiable information submitted in response to a survey will remain strictly confidential, subject to the provisions of this Privacy Policy. As is true of most web sites, we gather certain information automatically and store it in log files. This information includes Internet protocol (IP) addresses, browser type, referring pages, date/time stamp and click stream data. We use this information to administer the System, to track users' movements around the System, to gather information about your learning and engagement, and to gather demographic information about our user base as a whole. We provide access to a chat function to discuss issues and matters with our Customer Team. If you use our chat function to discuss issues with our Customer Team, you will be directed to a third-party host to facilitate the chat. This Privacy Policy governs the collection and use of information collected within the chat area and via other online forums made available on the System. If you choose to register for one of our Webinars, you will be directed to either a third- party site such as regform.com or an Aktrea maintained site. However, please note that our Privacy Policy only governs the collection and use of the data collected on the System. Our System could include social media features, such as Facebook "Like" button Widgets and "Share" buttons. Our System could provide access to chat and social functions, where you could discuss internal or external issues with you colleagues and other users. Please note that the same data privacy and security applies to this information as well. These features may collect your IP address, which page you are visiting on the System, and may set a cookie to enable the feature to function properly. Social media features are either hosted by a third party or hosted directly on our System. Your interactions with these features are governed by the privacy policy of the company providing it. Data you submit online may also be combined with other information you provide through other means of communication, such as postal mail.

4.(a) A special note about Institutional Customers If you are accessing this System because of a training or other program of your employer or affiliated enterprise ("Institutional Customer"), your actions, inputs, chat data, and work on or using the System including but not limited to hours worked, areas accessed, performance evaluation, scores and choices (collectively referred to your "Performance") may be shared with the Institutional customer only in case there is a separate agreement between Aktrea and the Institutional customer, and not otherwise. In case you do not wish for your Performance to be shared with the Institutional customer, kindly let the relevant representatives of the Institutional customer know, so that they can inform us accordingly. Only on the receipt of written instructions from such authorized representatives of the Institutional customer, will we exclude such reports related to your Performance from being submitted to them.

4.(b) A special note about Cookies Some pages of the System use cookies. Cookies are small pieces of software which are issued to your computer or device and which store and sometimes track information about your use of the site. Our cookies do collect or store your personally identifiable information, but we don't share such information to any other party unless agreed upon by you or as per clause 4(a). By using the System, you consent to our use of cookies as explained below. Most of our cookies are necessary for operation of the System or service that you request as a user of the System, such as to remember text you may have entered when you navigate back to a page in the same session. We also use cookies to provide optional features and functionality that you may access on the System. 5. Choice We may use your personally identifiable information for purposes not directly related to products and/or services you have requested or other requests or inquiries you have made, such as to send you e-mail communications, Aktrea's newsletter, information on new products or offers and information from Aktrea's partners unless you direct us not to do so by opting-out at the point where the information is collected. Additionally, you may opt-out from use of your personally identifiable information collected online for the purpose of sending such marketing or promotional communications at any time by sending an e-mail to contact@aktrea.com or by following, where available, the unsubscribe instructions contained within each of the newsletters or promotional communications you receive.

6. Sharing of Information Unless Aktrea has your permission or is required by law, or as otherwise set forth in this Privacy Policy, will not sell, rent, lease or otherwise provide your personally identifiable information to others, except in order to provide you with the products and services you request or as explained in Section 4(a) above. Aktrea will only share the personally identifiable information provided by you online with other Aktrea affiliates, resellers or other marketers of Aktrea's products, Aktrea's partners and/or service providers who may be used to ship products, provide technical support, handle order processing, or otherwise act on Aktrea's behalf for the purpose of marketing and providing Aktrea products and services, administering and operating the System and our business and sending marketing and promotional communications. Please remember that when you submit information to a discussion group or some other public or online forum, the information submitted will be deemed public information and will not be considered confidential or treated as such by Aktrea as other personally identifiable information you specifically provide to Aktrea, which is subject to this Privacy Policy. To request removal of your personally identifiable information from our blog or community forum, contact us at contact@aktrea.com In some cases, we may not be able to remove your personally identifiable information, in which case we will let you know if we are unable to do so and why. Also, as mentioned in Section 4(a), information related to your Performance shall be treated as confidential and can be shared with your employer or affiliated enterprise (referred as 'Institutional Customer') only if there is any express agreement for the same, and not otherwise. In case, there is an agreement for the same between Aktrea and your Institutional Customer, but you still don't want your Performance to be shared with your employer, you can write to the representatives of the Institutional Customer for their confirmation. Once confirmed and any written instructions received from authorized representatives of the Institutional Customer regarding the same, Aktrea will stop submitting your Performance to them.

7.Links Aktrea may provide you with links to other sites that are owned or operated by third parties. Please be aware that Aktrea is not responsible for the privacy practices of these sites. Aktrea does not endorse them or make any representations about them or any information, services, products or materials found on them. If you decide to access any of the third-party sites through links, we strongly encourage you to read their privacy statements.

8. Data transfer and security Aktrea is a global company. Hence, we may provide company information to our worldwide offices. The personally identifiable information you provide may be transferred to other Aktrea offices or stored on servers around the world. Also, in certain countries, Aktrea's service providers and outside contractors might undertake the collection, transfer, storage and processing of your personally identifiable information. At this point of time, users' personally identifiable information is primarily stored on Systems in Singapore. We will take necessary steps intended to safeguard personally identifiable information stored on our Systems from unauthorized access or disclosure. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, we cannot ensure or warrant the security of any information transmitted by you to us or from our online services, and you do so at your own risk.

9. How to access and correct your information Aktrea strives to keep your personally identifiable information accurate and up-to-date. If you find any inaccuracies in your personally identifiable information and wish to amend, correct or delete the same, please contact us through one of the communication methods described below in Section 14, Contacting Us. Aktrea will respond to requests to update personally identifiable information within 30 days of the reception of the request. To opt out of all future marketing and promotional correspondence from Aktrea, please follow the unsubscribe instructions contained in the e-mail communications you receive. Your request will be met within 30 business days.

10. Notification of Changes Aktrea reserves the right to make changes to this Privacy Policy. If we make any changes that result in the use of personally identifiable information in a manner different from that stated at the time of collection, we will first notify you via e-mail when available and provide you with the choice as to whether or not you will allow us to use your information in this different manner. In case, if there is a material change in our privacy practices that does not affect user information already stored in our database, a notice will be posted on the System notifying all users of the change.

11. Children Aktrea does not knowingly collect personally identifiable information from users under the age of 13. Children under 13 should not send any information about themselves to Aktrea. If a child under 13 years of age, submits information through any part of the System, and Aktrea becomes aware that the person submitting the information is a child, we will attempt to delete this information as soon as possible.

12. Specific National or Regional Privacy Rights Aktrea is a global company and has customers accessing the System from different parts of the world. In certain parts of the world, residents/citizens have the right to ask for certain information. We will do our best to fulfill such requests on a best efforts basis.

13. Acceptance of the Privacy Policy By using the System, you signify your assent to our Privacy Policy. If you do not agree with this Privacy Policy, please do not use the System. Your continued use of the System and following posting/notification of changes to these terms will mean you accept those changes.
